  1. MichNet Acceptable Use Policy

  5. Purpose
  6.  
  7. The purpose of MichNet is given in Article II of Merit Network,
  8. Inc.'s Bylaws which states in part that "... in pursuance of
  9. its mission in instruction, research, and service ... it is the
  10. role of Merit as [the operator of] a high-speed digital
  11. communications network to contribute broadly to educational and
  12. economic development in Michigan, ...".
  13.  
  14. Acceptable Use
  15.  
  16. This statement represents a guide to the acceptable use of
  17. MichNet. Any Member or Affiliate connected to MichNet in order
  18. to use the Michigan statewide network, or any other networks
  19. which are used as a result of their MichNet connection, such as
  20. NSFNET, must comply with this policy and the stated purposes
  21. and Acceptable Use policies of any other networks or hosts
  22. used.

  24. Each Member and Affiliate organization is responsible for the
  25. activity of its users and for ensuring that its users are
  26. familiar with the MichNet Acceptable Use Policy or an
  27. equivalent policy. In addition, it is expected that each Member
  28. and Affiliate will maintain and enforce its own Acceptable Use
  29. policies. At a minimum, Merit expects such policies will
  30. include:

  32. (1) To respect the privacy of other users; for example, users
  33.     shall not intentionally seek information on, obtain copies of,
  34.     or modify files, other data, or passwords belonging to other
  35.     users, or represent themselves as another user unless
  36.     explicitly authorized to do so by that user.
  37.  
  38. (2) To respect the legal protection provided by copyright and
  39.     license to programs and data.
  40.  
  41. (3) To respect the integrity of computing systems; for example,
  42.     users shall not intentionally develop programs that harass
  43.     other users or infiltrate a computer or computing system and/or
  44.     damage or alter the software components of a computer or
  45.     computing system.
  46.  
  47. The following policies and guidelines will be applied to
  48. determine whether or not a particular use of MichNet is
  49. appropriate:
  50.  
  51. (1) The intent of this policy is to make clear certain uses
  52.     which are consistent with the purposes of MichNet, not to
  53.     exhaustively enumerate all such possible uses.
  54.  
  55. (2) Merit may at any time make determinations that particular
  56.     uses are or are not consistent with the purposes of MichNet.
  57.  
  58. (3) If a use is consistent with the purposes of MichNet, then
  59.     activities in direct support of that use will be considered
  60.     consistent with the purposes of MichNet. For example,
  61.     administrative communications in support of acceptable
  62.     activities will be permitted.
  63.  
  64. (4) Malicious use is not acceptable. Use should be consistent
  65. with guiding ethical statements and accepted community
  66. standards. MichNet may not be used in ways that violate
  67. applicable laws or regulations. Use of MichNet and any attached
  68. network in a manner that precludes or significantly hampers its
  69. use by others is not allowed.

  71. (5) Connections which create routing patterns that are
  72.     inconsistent with the effective and shared use of the network
  73.     may not be established.
  74.  
  75. (6) Unsolicited advertising is not acceptable. Advertising is
  76.     permitted on some mailing lists and news groups if the mailing
  77.     list or news group explicitly allows advertising. Announcements
  78.     of new products or services are acceptable.
  79.  
  80. (7) Use of the network for recreational games is not acceptable
  81.     when such use places a heavy load on scarce resources (e.g.,
  82.     dial-in phone lines).
  83.  
  84. Remedial Action
  85.  
  86. When Merit learns of possible inappropriate use, Merit staff
  87. will notify the Member or Affiliate responsible, which must
  88. take immediate remedial action and inform Merit of its action.
  89. In an emergency, in order to prevent further possible
  90. unauthorized activity, Merit may temporarily disconnect that
  91. Member or Affiliate from MichNet. If this is deemed necessary
  92. by Merit staff, every effort will be made to inform the Member
  93. or Affiliate prior to disconnection, and every effort will be
  94. made to re-establish the connection as soon as it is mutually
  95. deemed safe.

  97. Any determination of non-acceptable usage serious enough to
  98. require disconnection shall be promptly communicated to every
  99. member of the Merit Board of Directors through an established
  100. means of publication.
